Q where is the will centre?
AMP Building 416 Flinders Street, Townsville City, Queensland. There is 2 hour parking along Flinders street directly in-front of and next to the Connolly Suthers office.
Q I thought that everything will go to my spouse automatically when I die, so why do I need a Will?
Incorrect: if you die without a Will (called being ‘intestate’) and you have children, it is unlikely that your spouse will receive everything.
Q I don’t own much, why would I need a Will?
A Will serves two functions; it determines who receives your assets, and it also appoints your Executor who administers your estate. If you don’t make a Will, your loved ones may need to apply to the Court for Letters of Administration in order to finalise your affairs, which is very expensive and can often result in arguments between family members.
Q I’ve made an Enduring Power of Attorney, they can sort everything out if I die, can’t they?
No! Your Enduring Power of Attorney is void the moment you die. It is illegal for an Attorney to act under Enduring Power of Attorney once someone has passed away.
Q I made a Will 30 years ago; it will still be valid, won’t it?
Not necessarily. There are many different reasons that your Will could be invalid, and the law has evolved greatly in the last 30 years. It is important that you have your Will checked to make sure it’s still valid.
